Samsung (Shenzhen Intermediate Ct. 2018) Facts: Huawei sued Samsung for infringement of two SEPS regarding 4G LTE in 2016 after the failure in the cross-licensing negotiations started from 2011. Huawei sought a permanent injunction. Holding: • • • Huawei's patents are SEPs. Samsung infringed Huawei's SEPs. Samsung maliciously delayed negotiations and was "at fault" during the negotiation.
