19 4 The number of investment disputes continues to rise. In 2012, the number of known treaty-based ISDS cases grew by 58, bringing the total known number of treaty-based cases to 514 at the end of that year. This constitutes the highest number of known treaty- based disputes ever filed in one year, with the general trend being 30-40 new cases annually since 2002 (figure 1). This is not altogether surprising given the large number of BITS now in force that provide for ISDS. Figure 1.
