There is one application for compensation under consideration. The value is yet to be determined. Litigation in progress Pending litigation that is not recoverable from RiskCover insurance and may affect the financial position of the department. Number of claims: 2 Contaminated sites Under the Contaminated Sites Act 2003, the department is required to report known and suspected contaminated sites to the department of Water and Environmental Regulation (DWER). In accordance with the Act, DWER classifies these sites on the basis of the risk to human health, the environment and environmental values. Where sites are classified as contaminated – remediation required or possibly contaminated - investigation required, the department may have a liability in respect of investigation or remediation expenses.
