Determining Compliance: Regulatory Considerations What are the legal implications of the cyber event? Licensees should consider the following: ➤ Did the cybersecurity event trigger individual, regulatory consumer or media notifications? ➤ If so, identify the jurisdictions where any affected persons may reside to assess which state laws may be triggered. Identify whether the type of data triggers additional statutory obligations under the law. ➤Is the data subject to HIPAA, GLBA, FCRA, FTC, FACTA? Review all relevant contracts and policies Review with your attorney notice requirements and plans for communicating with the media, regulators, etc. If notifications are necessary, prepare a notification plan.
