Trials are costly, involving attorneys, witnesses, expert witnesses and other "discovery". Preparation, including expert reports and attorneys' time, can be expensive. • Winning at trial is often difficult. © Very hard to get out of a case on Summary Judgment (but can use as a tool to resolve parts of the case) Companies don't want the adverse publicity and stigma that is sometimes associated with trials. 22 22
