H UNITED STATES V. WINANS (1905 - US SUPREME COURT) Due to narrow interpretation of Taylor by lower courts, and other federal agents' failure to act, exclusions of Tribal harvesters continued throughout the Columbia Basin. I Winans brothers, on the Washington side of Celilo Falls, erected a fishing wheel, for which they received a license from the State of Washington, and fenced out tribal harvesters. I Federal district court enjoined the fencing for almost seven years, but in 1903, Judge Cornelius Hanford dismissed the injunction, in order to place the Tribes “on an equal footing."
